Texas Internet gambling legality
Lawyers and lawmakers are trying to understand the law
of Internet gambling. They often make the job more
difficult for themselves by starting with two
unspecified and incorrect presumptions. The Internet
involves communications, it is assumed that
communications law that in particular way is protected
in some way by the United States Constitution and other
pert of the world where sport gambling is actively
played controls gambling on the Internet. The Internet
allows transactions to take place between individuals
located on opposite sides of the globe as easily as on
opposite sides of the street or near by areas. It is
assumed that Internet gambling is controlled by
international law and that it is a problem to be dealt
with solely by national federal governments. If actual
human speech is not analyzed under the law of
communications then a wager placed through computers
communicating with each other has no chance of being
protected like an exercise of free speech.
Gambling and the law
The Internet in general and
Internet gambling
in particular are very popular now a day among the
youngsters. The ability of large numbers of individuals
to easily communicate instantly across borders has been
around since the invention of the telegraph and all
modern amenities. The United States and other federal
governments become involve with regulating the telegraph
and similar technological breakthroughs. The telephone
and short-wave radio are the best examples of it. The
control of gambling has always been a matter left up to
the states under their police powers. Gambling involves
the health, safety and welfare of a state’s citizens.
The issues of morality are the part of it too. These are
almost always questions for the state governments to
decide. Federal governments are governments of limited
power so their role is to aid their states in
implementing state exercises of police power and not to
dictate morality for the entire nation.
Taxes gambling proponents
Gambling interests have risen in the Texas Capitol too
much, spending millions of dollars on lobbyists who are
trying to end prohibition on casinos. Pro-gaming forces
the advocates for bingo, casinos, slot machines and
expanding the lottery and million and million on their
lobbyists this legislative session, according to state
records is going to increase high. The investment
reflects gambling interests belief that the state is
struggling for revenue, as seen in the debate last week
over school finance and the fight expected. It means the
moment is ripe for new gambling to be approved. As
usual, one industry's gain will be considered another's
loss so such progress made by racetracks or casino
interests, is sure to provoke a request by bingo
operators that lawmakers act to protect their market.
